What it takes to qualify in Texas
Almost nothing about SBA eligibility is set by the state. The rules are federal: the business operates in the United States, it is a for-profit small business under the SBA size standard for its industry, you have invested your own equity, and you have tried and failed to get comparable credit elsewhere on reasonable terms. A lender in Texas is reading the same SOP as a lender in any other state.
For an acquisition, expect to put in at least ten percent of the total project cost. Half of that can come from a seller note, but only if the note is on full standby for the entire life of the SBA loan, with no principal and no interest paid. The other five points have to be real money you can source. That standby rule changed in June 2025 and it is the most common reason a deal structured on older advice stops working.
Rates do not move by state either. The variable cap is Prime plus a size-based spread, which is Prime plus 3.0 percent once the loan clears $350,000. Acquisition loans typically price near Prime plus 2.75 percent. Where Texas lenders genuinely differ from each other is appetite and speed, not price.
Collateral and your home in Texas
Texas is the collateral difference most worth knowing about, and it tends to run in the borrower's favour. Most states let you pledge your home for whatever you like. Texas is far more restrictive: the state constitution limits which debts a homestead lien may secure at all, to a short list that runs to purchase money, taxes, improvements, owelty on a partition and a compliant home equity loan. An ordinary business loan does not sit naturally in that list, and the practical consequence is that lenders here generally do not ask for a lien on a borrower's homestead. The exemption itself is unlimited by value and limited by acreage instead. Texas is also a community property state, which can change what a spouse's signature does, and that is worth raising with your lender early rather than at closing.
